1. Agreement
These terms are a contract between you and Qualia Tech Pty Ltd ("Qualia Tech", "we", "us"). By creating an account or using the AEInnerVerse web application at aeinnerverse.life (the "Service"), you agree to them. If you do not agree, do not use the Service.
Our Privacy Policy forms part of these terms.
2. What the Service is
The Service displays heart rate variability measurements, including root mean square of successive differences (RMSSD) values.
In Present Moment mode, a reading is processed so it can be shown to you and is then discarded unless you explicitly save a supported-client summary. The optional local 28-Day Baseline stores a derived daily RMSSD value in your browser; it is separate from your shared practice record. With client sharing consent, completed overnight exports are processed into hosted nightly summaries. Raw imported RR intervals are not retained in the overnight record. The Service also holds submitted morning check-ins, optional notes, clinician-chosen ACT actions and completion dates.
3. What the Service is not
This section is important. Read it before you subscribe.
AEInnerVerse displays measurements and practice records for clinicians and clients to review together. It does not establish a clinical conclusion or replace professional assessment and care.
Clinicians interpret the information and choose any ACT action; the software never assigns an action automatically. Observed return to a personal range does not establish that an exercise caused recovery.
The Service is not a substitute for assessment or care from a qualified health practitioner. Clinicians interpret measurements and decide next steps. Do not delay or disregard professional advice because of anything you see in the Service.
The readings shown are measurements taken by consumer equipment. They may be inaccurate, incomplete, or affected by movement, positioning, caffeine, illness, medication or a hundred other things. Do not treat them as clinically reliable.
The Service is not for emergencies. If you are unwell, or concerned about your health, contact your doctor. In an emergency, call your local emergency number. In Australia, call 000.
4. Eligibility
You must be at least 18 years old and capable of entering a binding contract. Qualia Tech Pty Ltd is an Australian company serving clinicians and their invited clients internationally. Clinicians must hold an appropriate professional registration or membership where they practise and obtain administrator verification before checkout. Availability depends on local law, professional requirements and payment-provider restrictions. Verification does not establish regulatory approval of the software in any country. You are responsible for using the Service lawfully in your location. Nothing in these terms excludes any mandatory consumer rights that apply to you.
5. Your account
You must give accurate registration details and keep them current. You are responsible for keeping your password secure and for everything done through your account. Tell us immediately if you believe your account has been accessed without your permission. One person per account. Do not share your account.
6. Acceptable use
You must not:
- use the Service for any unlawful purpose
- use the Service to make clinical, employment, safety or insurance decisions about yourself or anyone else
- present output from the Service as a medical assessment
- copy, modify, reverse engineer, decompile or attempt to derive the source code of the Service
- scrape, data mine, or extract data from the Service by automated means
- resell, sublicense or commercially exploit access to the Service
- attempt to interfere with the security or operation of the Service
- upload anything malicious, unlawful, or that infringes another person's rights
We may suspend or close your account if you breach this section.
7. Fees and subscriptions
The AEInnerVerse clinician licence is US$150 per month, billed in United States dollars. Australian GST is included in that price where the sale is taxable; it is not added on top. Tax details and the total are shown before payment. Overseas taxes depend on the location and tax status of the customer and the applicable rules. Your bank may apply currency conversion fees. Clinicians must provide accurate professional registration details. An administrator verifies each registration before checkout and workspace access. A paid licence covers all clients that clinician invites and who accept. Clients do not pay an individual subscription. Rejection or suspension blocks that clinician and their clients but does not cancel billing; cancel through your account. The optional InnerVerse HRV Device is sold separately through Shopify for US$88 before any applicable local taxes and shipping.
Licences are billed monthly in advance and renew automatically each month until you cancel. You can cancel at any time through your account settings. Cancellation takes effect at the end of the current monthly period, and you keep access until then.
Except where required by the Australian Consumer Law, fees already paid are not refundable, including for a partial month.
We may change our fees. We will give you at least 30 days notice by email before a change applies to your subscription. If you do not accept the new fee, cancel before it takes effect.
Payments are handled by a third party payment provider. We do not receive or store your card details.
8. Intellectual property
Qualia Tech owns all intellectual property in the Service, including its software, design, text, graphics and name. AEInnerVerse is a trade mark of Qualia Tech Pty Ltd.
We grant you a personal, non-exclusive, non-transferable, revocable licence to use the Service for your own personal use while your subscription is current. Nothing in these terms transfers any intellectual property to you.
9. Your data
Local baseline readings remain in your browser. Explicitly shared live summaries, overnight summaries, submitted check-ins and ACT records are held on our hosted infrastructure under the access and consent controls described in the Privacy Policy. See clause 2.
We hold your account information, such as your name, email address and subscription status, for as long as your account is open. You grant us a licence to host, store and process that information solely for the purpose of providing the Service to you.
Our handling of your information is governed by the Privacy Policy.
10. Availability
We aim to keep the Service available but we do not promise it will be uninterrupted or error free. We may suspend the Service for maintenance, upgrades or repairs, and will give notice where practical. We may change, withdraw or discontinue features at any time.
We may discontinue the Service entirely. If we do, we will give you at least 30 days notice and refund any prepaid fees for the period after closure.
11. Australian Consumer Law
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms excludes, restricts or modifies those guarantees.
For major failures with the service, you are entitled to cancel your service contract with us and to a refund for the unused portion, or to compensation for its reduced value. You are also entitled to be compensated for any other reasonably foreseeable loss or damage. If the failure does not amount to a major failure, you are entitled to have problems with the service rectified in a reasonable time and, if this is not done, to cancel your contract and obtain a refund for the unused portion of the contract.
12. Liability
Subject to clause 11, and to the maximum extent permitted by law:
- we are not liable for any indirect, incidental, special or consequential loss, or for loss of profit, revenue, data or opportunity
- we are not liable for any loss arising from your reliance on a reading displayed in the Service, or from any decision you make on the basis of one
- our total liability to you for all claims in any twelve month period is limited to the amount you paid us for the Service in that period, or, at our option, resupplying the Service
You indemnify us against any claim brought by a third party arising from your breach of these terms or your unlawful use of the Service.
13. Termination
You may close your account at any time.
We may suspend or close your account immediately if you breach these terms, if we are required to by law, or if continuing to provide the Service to you would expose us to legal risk. Where the circumstances allow, we will give you notice and an opportunity to fix the problem.
On closure, your licence to use the Service ends and your data is handled as set out in the Privacy Policy.
14. Changes to these terms
We may change these terms. We will publish the updated version at aeinnerverse.life and, if the change is material, email you at least 30 days before it takes effect. Continuing to use the Service after that date means you accept the change. If you do not accept it, close your account.
15. General
These terms are governed by the law of Victoria, Australia, and you and we submit to the non-exclusive jurisdiction of the courts of Victoria.
If any part of these terms is found unenforceable, the rest continues to apply.
Our failure to enforce a term is not a waiver of it.
These terms, with the Privacy Policy, are the entire agreement between you and us about the Service.
